The Off-Highway Vehicle Act, R.S.A. 2000 and regulations or amendments shall
apply with the exceptions of the following:
a) Operators of off-highway vehicles on County highways shall be permitted to travel on the shoulder or, where there is no shoulder, on the extreme right
hand side of the highway (ditch) and shall travel in single file at all times;

b) The hours of operation of off-highway vehicles on County highways shall be restricted to the period of time between 8:00 a.m. and 11:00 p.m. daily.

c) The maximum speed at which off-highway vehicles are permitted to travel on County highways is 30 km./hr. or less if posted at a reduced speed.[/B]FINES
A notice of form (commonly called a traffic tag or a violation ticket) may be issued by a peace officer to any person charged with a breach of any of the provisions of this by-law and the Acts shall apply in regard to the payment.
Section 2(a)
Off-Highway vehicles on County Highways not/on right shoulder/
in right ditch/in single file $ 50.00
Section 2(b)
Off-Highway vehicles on County Highways/before 8 a.m./
after 11 p.m. $ 50.00
Section 2(c)
Off-Highway vehicles on County Highways in excess of/
30 km. per hour/posted speed $ 50.00
Section 3(a)
Operation of Off-Highway vehicles in/County Park/County
Playground $ 50.00

I think that's a pretty awesome bylaw. better than zero tolerance for OHV's by a long shot....

Depends on the county.... Lac Ste.Anne is 40 km/h

3. Any person qualified to operate an off-highway vehicle may operate same on any Municipal highway
within Lac Ste. Anne County, subject to the following conditions:
(a) The hours of operating an off-highway vehicle on Municipal highways shall be restricted to the
period of time between 7:00 a.m. to 11:00 p.m. in any one day.
(b) The maximum speed at which off-highway vehicles are permitted to travel on Municipal highways
is 40 km per hour unless otherwise posted at a lower speed limit.
(c) Operators of off-highway vehicles on Municipal highways shall travel on the extreme right hand
side of the highway and shall travel single file at all times.
(d) All off-highway vehicles travelling on Municipal highways shall be equipped with at least one
headlight and tail light(s). At any time during the night time hours or at any other time, when due to
insufficient light or unfavorable atmospheric conditions objects are not clearly discernible on the
highway at a distance of five hundred (500) feet ahead, no off-highway vehicles shall be in motion
on a highway unless the headlight and tail light(s) are alight.
(e) Without restricting the generality of the foregoing the provisions of The Traffic Safety Act shall
apply to the operation of an off-highway vehicle on Municipal highways.
(f) All off-highway vehicles must be duly registered and insured pursuant to The Traffic Safety Act.
4. No person shall operate an off-highway vehicle on a sidewalk or boulevard.
5. No person shall operate an off-highway vehicle on municipal and/or school reserve property,
playgrounds, campgrounds, or school grounds, with the exception of municipal/school employees or
contractors during the course of their employment/work.

Section 127 of the Traffic Safety Act
allows for the seizure of the OHV for
any of the infractions listed above.


•Carelessly drive OHV on any property public
entitled/permitted to use — $402.00
•Permit another to drive OHV contrary to
Act — $230.00
•Driver of OHV fails to stop before crossing
highway — $230.00
•Passenger of OHV fails to disembark from
OHV before crossing highway — $230.00
•Driver of OHV fails to yield to all motor
vehicles on highway when crossing —$230.00
•Driver of OHV fails to yield to all other classes
of motor vehicles — $172.00
•Driver of OHV fails to stop for Community
Peace Officer (CPO) —$172.00
•Driver of OHV fails to remain stopped for
CPO until permitted to leave —$172.00
•Passenger of OHV fails to provide name/
address to CPO —$172.00
•Failure to produce document(s) to CPO as
requested — $115.00
•Tow trailer/sleigh/cutter/other vehicle behind
OHV — hitch/attachment does not prevent
towed vehicle from colliding with towing OHV
during travel downhill/when towing OHV stops
— $57.00

And really, $172.00, that's not even worth the time it takes to write the ticket.
If your gonna get a ticket make is worth framing and putting on your wall???

failing to stop is worth less than the basic operating OHV in unauthorized area

Might as well take the chance and go for it...

This is the reason why LSA county does not enforce the no riding on provincially operated highway ditches... they will check for papers and thats it.

If you do end up with a fine for operating in a provincial ditch by a county bylaw officer, accept the fine with a smile and call the county durring business hours to have the fine voided....

I think the idea is that, if they do catch you later on, you pay the fine + the fine for running. So if you opt to run, don't wuss out halfway.

Ha Ha Brutal, I'd fight it for the sake of fighting it. Wasn't Officer Ducharme was it?

Tell them your speedo was reading 30, and it didn't specify that it was MPH
