[h=3]What is this Class Action about?[/h][FONT=&quot]A national class action lawsuit was commenced in Québec (the “Class Action”) against Arctic Cat and Yamaha (the “Defendants”). The Plaintiff in the Class Action alleges that the starter installed in the Affected Snowmobiles was deficient and seeks damages from the Defendants.[/FONT]
[FONT=&quot]The Defendants deny any wrongdoing or liability. Nonetheless, a National Settlement Agreement has been reached whereby all claims by those who purchased or leased the Affected Snowmobiles will be settled (the “National Settlement Agreement).[/FONT]
[FONT=&quot]A virtual Court hearing to approve the National Settlement Agreement has been scheduled for [COLOR=#DC3545 !important]June 18, 2021 at 9am EST.[/FONT][/COLOR]

[h=3]Who can receive benefits under this Class Action?[/h][FONT=&quot]Settlement Class Members are all persons who purchased or leased a snowmobile with a 7000 or 1049cc engine of the following models, in Canada for the years 2014 to 2018, and who did not validly opt out of the National Settlement Agreement:[/FONT]

[FONT=&quot](collectively, the “Affected Snowmobiles”)[/FONT]
[h=3]What type of benefits may you be eligible for?[/h][FONT=&quot]The National Settlement Agreement provides for the following Settlement Benefits to Settlement Class Members, subject to the terms and conditions stipulated therein.[/FONT]

  • Category 1 Claim (Extended Repair Program) – an installation of the Permanent Fix by an Authorized Dealer
  • Category 2 Claim (Repair Work Credit) – a single Credit of either $80 CAD or $160 CAD, as the case may be, irrespective of the number of Affected Snowmobiles owned or leased, redeemable against any in-store or on-line Available Transaction made during the Claims Period
  • Category 3 Claim (Out-of-Pocket Expenses) - a single Credit of $200 CAD per Incident, up to a maximum of three (3) Incidents, for a maximum combined Credit value of $600 CAD, as the case may be, irrespective of the number of Affected Snowmobiles owned or leased, redeemable against any in-store or on-line Available Transaction made during the Claims Period
  • Category 4 Claim (Settlement Benefits to Past Owners) - an amount payable in cash equal to the combined value of the Credits he or she would otherwise be entitled to receive and redeem during the Claims Period

[h=3]Summary of Your Legal Rights and Options[/h]
Do NothingIf you are a member of the Settlement Class and wish to participate in the National Settlement Agreement, you do not need to do anything at this time.
If you do nothing, you automatically remain a Settlement Class Member (if you qualify) and you will be legally bound by the National Settlement Agreement, and by the releases in the National Settlement Agreement. You will no longer have the right to bring forth other legal proceedings in relation to the matters alleged in the Class Action against the Defendants.
If the National Settlement Agreement is approved by the Court, further information about how to submit a claim will be made available on this website.
Opt Out of the SettlementIf you are a member of the Settlement Class and do NOT wish to participate in and be bound by the National Settlement Agreement, then you must opt out.
By opting out, you are choosing:

  • not to take part in the National Settlement Agreement; and
  • not to participate in any of the Settlement Benefits.
The deadline to opt out of the National Settlement Agreement and Class Action is [COLOR=#DC3545 !important]April 21, 2021[/COLOR].

Too bad about lawyers! Imagine this a new Cessna 152, The Ski Doo Elan of aircraft, no longer in production, no more complicated than a riding lawnmower, would cost probably $4000 or $5000 to buy, because of lawyers would be nearer $200,000!!!!!!!!!!

Too bad about lawyers! Imagine this a new Cessna 152, The Ski Doo Elan of aircraft, no longer in production, no more complicated than a riding lawnmower, would cost probably $4000 or $5000 to buy, because of lawyers would be nearer $200,000!!!!!!!!!!

Sorry , are you trying to say that a Cessna 152 could be produced for a cost of 4-5K ? I know it's a simple aircraft but there is no way in the world it could be produced for that.

Sorry , are you trying to say that a Cessna 152 could be produced for a cost of 4-5K ? I know it's a simple aircraft but there is no way in the world it could be produced for that.

Here is my logic,
A new Nissan Versa Sedan – $12,815. .., there is a tremendous amount more to a Nissan than a simple airplane, I think if Nissan factory built a Cessna 150 logic says $4000 to $5000!!! Some push pull cables, some pushrods, simple instruments!! Some lawyer comes along and says to a person that crashed his 1930 airplane because of incompetence he will sue because a new Cessna may have gone to a pushrod instead of push pull cables and Cessna didn't upgrade the 1930 airplane.
