For those who don't already know this, yesterday I was out looking for a moose riding my atv and ran into some CO's. My rifle was in a kolpin scabbard, in the softcase zipped closed. They asked me if the firearm was loaded and I answered, "No there isn't a round in the chamber". He then asked if there were any rounds in the magazine. I said "yes the magazine has rounds in it, but the chamber is empty". He asked for my rifle and I handed it to him. He proceeded to to tell me "your firearm is considered loaded even though there isn't a round in the chamber", and I got charged for carrying a loaded firearm in a motor vehicle. So I asked him when did an atv become a motor vehicle? He replied a couple of years ago the definition of a loaded firearm and motor vehicle both changed. So I started asking more questions and basically everything in BC is now classed a motor vehicle, even e-bikes. Another gov't overreach cash grab. I got a $230 dollar fine.

I don't want to come off like a dick or anything but probably should read the regs every year before you head out. There are always some changes to the laws.
This looks to be a federal law, it applies to Alberta. This fine was a firearms violation, not a hunting violation. So every time they quietly change wording in Ottawa I guess a person needs to scour the paperwork for changes. I shared so others can be made aware, so many people are not aware. The only time you can have your magazine in your firearm is if your on foot walking in the bush now.

In Sask we haven't been able to have rounds in an attached magazine for years. The only difference is a muzzle loader where you can have powder and sabot loaded into barrel as they are not considered loaded until you put the cap or primer in.
It always applied when in a car/truck, but the addition of off highway vehicles is new. With the amount of bad bear encounters that are occurring this makes a lever gun useless, the amount of grizzly bears in the area is dumb.

Thanks Clode. Like you say not everyone is aware of the changes being made quietly in the background. There should be some kind of law to prevent the feds from making changes and not notifying those affected.

They say ignorance of the las is not excuse, but how do you keep up with the laws when they change without notice.

It should be provincial and not federal, that way people can be more up to date and have more control over what laws get put in place.

Thats why I shared, to make others aware, and so the word gets spread.

Thats the problem, two sets of rules that overlap in certain areas.

Another thing that just changed, you need to show your PAL to buy smokeless powder for reloading as of June of this year.

Did you by any chance ask if this applied to boats as well? The last time I found it and read it was as long as the "propulsion source was off and the vessel was anchored you were allowed to discharge a firearm from it". To me this is no difference then putting a truck in park and shutting it off but if everything is motor vehicle now this significantly changes things.

NVM, as per the alberta Reg's motorboats are exempt.

OHV (Off-Highway Vehicle) – any motorized vehicle designed for cross-country travel on land, water, snow, ice, marsh or swamp land, or on other natural terrain. [Exceptions: motor boats, as well as four- wheel-drive vehicles and motorcycles registered in accordance with the Traffic Safety Act.] OHVs include the following kinds of vehicles when they are designed for cross-country travel as described above: l four-wheel drive or low pressure tire vehicles, l motorcycles and related two-wheel vehicles (including bicycles equipped with an electric motor), l amphibious machines, l all-terrain vehicles, l miniature motor vehicles, l snow vehicles, l minibikes, or l any other means of transportation that is propelled by any power other than muscular power or wind.

As for hunting in Alberta per the hunting regs you can not shoot from a boat at game unless said boat is human powered or at anchor. Also can not have ammo in breech, chamber or magazine while moving. Page 28 number 7 of general regs

Is this a change? Years back when I hunted I thought this was allowed. Also, would this apply to lever actions and built it mags? What a crock
