Owls head snowmobile accident info

I have been checked before at owls head parking lot.They were looking for insurance and registration. That was three years ago and we were told it was manditory to have registration and insurance.
And yes our friend had full coverage .
I do as well. . So did things change

I’ve read that the guy stayed till the chopper took him away, if true, seems like a reasonable time to depart imo.

ive crossed trail lots, coming out of the trees around the trail is great riding (in Sicamous). Obviously looking both ways, but some guys fly down those trails.

Curious if the injured fella has his own insurance?? The argument could be made he was crossing the trail and the other guy smashed into him?
That ride at your own risk saying drives me nuts when it comes to negligence cases like this.

If the mountain kills you that's one thing.

If an idiot kills you that's another.

Isn’t the owls head trail along with other trails in the area on fsr roads? If so minimum $200000 liability insurance and registration is required.

That only applies to an ACTIVE logging road or a FSR that is maintained or kept open by forestry or transportation department. In the case of a snowmobile trail running on a FSR, such as the Owl's head trail, the FSR is considered inactive (closed) during winter months with exception if it was to be activated for one reason or another such as logging, then it would be plowed and not groomed. Insurance does not apply and never has on that trail and many other club trails.

Who ever checked you for insurance was full of BS...i've been checked on the hiway with sleds on deck, on trails and even in the back country and never was insurance ever mentioned. All they want to see is registration's and proof of ownership. Unless your crossing an active road or traveling on an active road it is not needed or required....or ever has been required.

It's sad to hear these thing and i feel for the one's involved, seriously. But in reality it is our own responsibility to know the risk's and be prepared for the worst.
I do not understand people that go through life with the expectation that other's will pay up when thing's go sideway's.
I carry life insurance and a disability insurance in the hope of never using them but it is my responsibility if i partake in a high risk sport to make sure my family is financially going to be ok.
There are NO ICBC in the back country, LOL, not even for your truck the moment you drove off the road maintenance boundary, your insurance is VOID.

Again not trying to be the arse here but as highlighted above this is reasonable if true.
Fact is the dude has no legal obligation's as he did nothing wrong according to the law. Though a moral obligation maybe.
Cops want to talk to him, more likely related to making sure that the sled is registered, if it's not he will get a fine and that is all.

I was checked by CO’s for Insurance and registration last year at sale as stated above they mentioned that it’s now been 3 years and they were going to start writing tickets. A buddy of mine was involved in an accident years ago now in bc even more innocent tho sled started at full throttle took out multiple sleds and broke legs of another guy. Lawsuit followed for lost wages ect and eventually some insurance company paid. But because there was lack of direct insurance on said sled everyone in and around accident was named in lawsuit. Moral of the story no such thing as no accountability regardless of if it was an accident in major injuries people pay. If your riding around without insurance you risk losing your shirt and your a clown. You can probably get 2million liability for $200 on a sled nowadays. I hope all the best and speedy recovery for those involved.

Im not sure where you got this information from, but this is not the case. I make my living driving off "the road maintenance boundary" and ICBC coverage has never been an issue.

That is true because the road has an open status, so it is deemed ACTIVE. Plus, i believe logging operation's carry a special rider for that purpose. For non commercial or personal vehicle that may not be the case.
I know of an individual who had a head on with a crummy truck on a logging road, he was getting fire wood and ICBC denied him because he was driving on an uncontrolled road and suggested he talk to the logging operator for coverage. Long story short, he did and the operator covered the damage.
Now he could had gone through ICBC but he would have had to pay his deductible and that is what he did not want as he claimed they were at fault as he was stopped.

The "Ride at your Own Risk" is only occasionally effective for those who operate and maintain the road gainst some kinds of negligence such as allegations the road was not properly built or maintained so my vehicle was damaged and I was injured. it does not protect anyone else for their negligence in using the road, trail or whatever. The sign has no legal effect on this situation and does not forgive anyone else's negligence.

As I have seen some not clear on what is negligence, the basic items are: 1. You must owe a duty to do, or not do something; 2. There must have been a breach of that duty; and 3. There must be damages. This incident meets all three of these points starting with you cannot proceed unless you know it is safe to do so which it sounds like the fellow did.

Hope they find him

No idea what your friends situation was but in the case of snowmobiles and ATV,s etc, the insurance is valid wherever you are on road or off.

Yes correct liability insurance fallows you.
I would say a vast majority of BC registered sled's have no liability insurance on them, as it is not requirement, only if your riding on or crossing an active road. A trail is not considered a road.

CKMP was reportedly doing some filming in the area at that time. Rene was also reportedly guiding some french guys the next day.

This is the only sensible post on here ... thank you. I don't think anyone knows if you need insurance or not .

I thought it was a rather productive conversation. Everyone is so easily offended nowadays.

I missed the notice that this is now Crime Stoppers. Seriously, if anyone has any information on this they should be calling the RCMP to report it cuz I am pretty sure they don't monitor this
