Typical cop answer, not true.

They must have reasonable and probable grounds to believe that you have committed some type of offence in order to legally search your vehicle. Refusing a search does not constitute probable cause. But that usually doesn't deter them because then they just lie and say they smelled alcohol (or some other lame excuse to the judge if gets to court) and search anyway.

You need to challenge the cop and ask what offence he suspects you have allegedly committed, that usually puts an end to his fishing trip.

Never had a problem in town before. That being said there are a lot of young guns now in golden, and they are running check stops all over.

what do they mean by certification of lift install? That a professional has completed it?

as for the tires, that sucks but anything beyond the wheel well is not legal.

Yup and if installed by your self you need it inspected Any lift over 4 inchs I ask him to email me a copy of the legislation for this if he follows threw I will post it

My buddy didn't have his sled tied down in his enclosed...hit the ditch, sled came pretty close to going through his back window

technicaly if its in the back of your truck it has to be secured....city of Calgary had inspectors at dumps couple xmas.s back and folks that were takein trees to landfills were getting tickets cause trees weren't secured...this town has gotten wierd

Makes sense. It is part of the transportation laws.

Lots of unsecured articles come out of moving vehicles and almost kill people. It was a few years back on Stoney Trail a break drum fell off a Semi, then rocket launched out of a vehicles tires after being run over, and killed a 20 year old women driving behind it when it went thru her window and hit her in the head....

remember that..was sad deal...driving in Calgary has become a nightmare..lotsa new Canadians bouncein about..had one in back alley tryin to get up a hill in some car with summer tires on...needless to say he ended up sideways and in need of a tow...now bein theres a blow goin on in Calgary is good its the weekend or thered be 200+ plus accidents on the norm everytime it snows around here..some folks just don't have a clue when winter hits

Interesting post there Craig3972, I am really intrigued with your guidance however you are partially wrong.... I would hate to see some young person get pulled over and start off on the wrong foot with the local police. I hope I can help out a bit and clear up this question.... now back to the original reason for this discussion and that is: a guy was upset over the lift kit in his truck and then getting a tint ticket... He was OK with that (probably not real happy) but he knew it was illegal. As for the lift kit and tires well I would also like to see that legislation on that. Firstly remember it is a privilege and not a right to operate a motor vehicle and safety regulations have been put in place to ensure the highways are safe for all road users. Now onto your suggestion that the Police need to have reasonable grounds to search your vehicle is partly true. The threshold for the test of law on a search for criminal activity is very high, there are a lot of legal tests that must be met in a court of law in order for that search to move forward. Now... back to the post of traffic safety, vehicle safety, cargo securement, dangerous goods Police officers and Peace Officers can conduct a safety check of a motor vehicle and its cargo without a warrant and without you being arrested and without your consent. Please do not confuse a "search" and an "inspection" those are two different animals with whole bunch of different rules.... Now back to your comment on the search for criminal activity.. If you are "arrested" for a criminal offence the police can "without a warrant" search for evidence anywhere in the vehicle/trailer relating to the offence. If you have the time you should go to the Transport Canada website and read about cargo securement, dangerous goods, secondly go to the Criminal Code and do some reading. As for the blanket statement "but that usually doesn't deter them" is rather harsh.... I have been stopped and checked by both the RCMP and DOT in B.C. while sledding and I have never had any problems. I know my comments may never change your belief, but you brought up a questionable statement that I believed needed to be moved forward in a positive way. I also liked the post here about the loose cargo almost going through the back window...., another one of many examples of insecure cargo and why inspections can be done for cargo and dangerous goods securement without a warrant or being arrested. And to think, all I wanted to do was check out the snow conditions to do some sleddin...

Yeah drivers here are terrible. Can't wait for the day I don't have to deal with traffic in this city. I'd rather deal with the occasional stupid tint ticket then the clueless drivers in this city!

So after reading all the posts here I decided to look into the legislation (Alberta) and this what I found:

Traffic Safety Act s.66 allows Police/Peace Officers to enter and inspect vehicles to ensure vehicle safety compliance.

There is no need for reasonable and probable grounds, unless it's a criminal matter that Police are investigating. So if you have gear in an enclosed tray then the cops can look inside to ensure compliance.

As for certification of inspection, well i couldn't find anything specific on that HOWEVER if you've made a significant modification such as a lift then the certification will help establish that it was done properly and the other equipment i.e. headlight height from ground, are still in spec.

No point sending someone to court if they can provide evidence that the vehicle is in good nick!

If your in Alberta and love your toys then you need to have a good read of the following:

Traffic Safety Act
Use of Highway Rules of the Road
Vehicle Equipment Regulations.

Google it, download the .pdf, have a read.., you don't have be a lawyer to understand it (god knows I'm not )

PS: I had a good chuckle at "feeling targeted" because you drive non-spec truck down the highway.
